- Credit Counseling/Personal Financial Management Certification:
Please visit http://www.usdoj.gov/ust/ for the most recent information on approved credit counseling agencies and approved personal financial management instructional course providers. That website also has links to contemporaneously updated information generated by the Bureau of the Census and the Internal Revenue Service for completing the Statement of Current Monthly Income form.

Voluntary petitions will be rejected if credit counseling is not completed before the filing of an individual voluntary petition or if an 11 U.S.C. § 109(h)(3) or (h)(4) exemption is not met as required by the statute and Interim Federal Rule of Bankruptcy Procedure 1007(3). (In the case of electronic submissions by attorneys, those cases will be dismissed.)

- GPO 2005-6 Adoption of the Interim Federal Rules of Bankruptcy Procedure and Forms
GPO 2005-6 is effective October 17, 2005, to adopt the Interim Bankruptcy Rules and Forms promulgated by the Judicial Conference to address the changes in the Bankruptcy Code under the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. The GPO references as an attachment the Interim Bankruptcy Rules which can be viewed in blackline form by clicking here (it is a large file of 95 pages, 164 KB), the referenced Forms effective for cases filed after October 17, 2005 can be viewed on the Forms page of our website.
- Amended GPO 2006-1: In the Matter of Adopting Transitional Local Bankruptcy Form 1002-1--Cover Sheet and Form 1002-2 Counseling Statement for Voluntary Petitions Filed on or After June 1, 2006.
Debtors and attorneys who commence new bankruptcy cases on or after June 1, 2006, are required to submit this Cover Sheet and this Credit Counseling Statement.

General Procedure Order 2006-2 In the Matter of Establishing Deadline to Raise Employee Income Record Deficiencies Under 11 U.S.C. § 521. This GPO sets forth a deadline for any party to object to the designation on the Court docket of evidence of an employee income record.

- Please Note: Pursuant to General Procedure Order 2008-04 the Clerk of the U.S. Bankruptcy Court is authorized to close the Clerk's Office facilities on Friday, December 26, 2008 and Friday, January 2, 2009. The court will remain open for filing any paper, issuing and returning process, making a motion, or entering an order by means of the electronic filing process; or in the event the electronic filing process is unavailable or inapplicable, by contacting by telephone the U. S. Bankruptcy Court Clerk's Office at (720) 904-7300 during normal business hours on Friday, December 26, 2008 and Friday, January 2, 2009. (Individual Judges, at their discretion, may hold hearings or conduct business on those days.) Please click here for more information.
- Trustee Copies: The United States Trustee announced that effective for cases filed on or after March 1, 2008, Chapter 7 Trustees and the Chapter 13 Trustee in Colorado will no longer require paper or "hardcopies" of bankruptcy petitions, schedules, or forms and their amendments which are filed with the United States Bankruptcy Court.
- NEW REAFFIRMATION AGREEMENT COVER SHEET. General Procedure Order 2008-2 requires Cover Sheet for Reaffirmation Agreement for agreements filed on and after May 1, 2008. The form of the cover sheet is similar to the form being considered by the Judicial Conference to be adopted as an Official Form. Click here to see the GPO 2008-2 and the new cover sheet.
- GUIDELINES FOR REQUESTS UNDER 11 U.S.C.§ 362(c), (h) and (j).
The Court has issued guidelines on matters related to the termination or absence of the automatic stay, requests for an extension or imposition of the stay or requests to determine that property is of consequential value. These guidelines likely will be incorporated in some form of a Transitional Local Bankruptcy Rule. We would appreciate your constructive comments and ideas during this interim period to help us enhance the procedure in this area. Please note that on the very last page of the guidelines, there is information for Electronic filers to assist you in using the proper events when filing motions under 11 U.S.C. § 362(c), (h) or (j). - GPO 2005-2 Compliance with the Servicemembers Civil Relief Act of 2003. Effective August 1, 2005, parties will be
asked to comply with the Servicemembers Civil Relief Act of 2003 ("SCRA").
Compliance entails the filing of an affidavit in compliance with the provisions
of SCRA on motions for relief from the automatic stay and default judgment,
this requirement is different from the Soldiers' and Sailors' Civil Relief
Act; also, individual debtors are to file a declaration of military status
with their voluntary petitions. Click

- Chapter 13 Trustee's Recommended Procedures for the Submission of Tax Returns
There is a new chapter 13 email address designed solely for the Debtor's submission to the Trustee of the tax return/affidavit required to be provided by 11 U.S.C.521(e)(2)(A)(i). Providing the return by email will save copies and postage and will allow the Trustee to monitor her receipt of the returns more efficiently. Please advise your staff or client to provide the return/affidavit to taxreturns@ch13colorado.com
